Abnormally Low Tender

A bid so low the contracting authority must investigate before awarding: sustainability, labour law, or state-aid concerns.

Under Regulation 69 of S.I. 284/2016 (transposing Article 69 of Directive 2014/24/EU), a contracting authority must request an explanation in writing where a tender appears abnormally low in relation to the works, supplies, or services. The authority can only reject the tender if the explanation does not satisfactorily account for the low price, for example, where the bidder cannot demonstrate compliance with environmental, social, and labour law obligations. Common in construction and FM tenders where a price gap of 20–30% below the next bidder triggers scrutiny.
