A formal written instruction to change the scope of a public contract, must be agreed and documented before the work is done.
Under Irish public works contracts (PW-CF series), variations to the scope, specification, or programme must be issued by the engineer or contracting authority in writing as a Variation Order before the work is carried out. Pricing is generally based on the rates in the original Bill of Quantities; where no comparable rate exists, fair valuation applies. Verbal instructions are not enforceable. Disputes over variation pricing or entitlement are a leading cause of construction claims. EU procurement law (Regulation 72, S.I. 284/2016) restricts the size of permissible variations, material changes can require a new procurement competition.
