Procurement by entities operating in water, energy, transport and postal sectors, governed by S.I. 286/2016 with higher thresholds than the public-sector regime.
The procurement regime applying to utilities buyers (Iarnród Éireann, ESB Networks, Uisce Éireann, Bus Éireann, An Post and others) under Directive 2014/25/EU and S.I. 286/2016. Higher financial thresholds apply (€432,000 for goods/services, €5,404,000 for works in the 2026–2027 cycle, effective 1 January 2026 per Commission Delegated Regulation (EU) 2025/2150). Utilities buyers can use a wider range of procedures, including negotiated procedure with prior call for competition as of right, and can run qualification systems instead of advertising each contract.
