S.I. 130/2010 as amended — the rules letting unsuccessful bidders challenge a procurement decision in the High Court.
The European Communities (Public Authorities' Contracts) (Review Procedures) Regulations 2010 (S.I. 130/2010), as amended by S.I. 192/2015, transpose the EU Remedies Directive into Irish law. They give unsuccessful bidders the right to apply to the High Court to set aside an award decision, declare a contract ineffective, or recover damages. Applications must be made within strict time limits — generally 30 calendar days of becoming aware of the decision. The mandatory standstill period (14 days electronic, 16 days postal) exists to give bidders a window to seek a debrief and apply for relief before the contract is signed.
